Bear true faith and allegiance to the U.S. Constitution, the Army, your unit and other Soldiers. Bearing true faith and allegiance is a matter of believing in and devoting yourself to something or someone. A loyal Soldier is one who supports the leadership and stands up for fellow Soldiers. By wearing the uniform of the U.S. Army you are expressing your loyalty. And by doing your share, you show your loyalty to your unit.

To summarize, a crime like TREASON requires two general elements: An intent (mens rea) and an action (actus reus).
Can you prove to a board of officers that Milley intended to betray America? No.
Can you prove he actually did something . . . some action . . . that constitutes betrayal? No.
Legally then . . . sorry . . . he's not treasonous.
He may not even be "disloyal." The Army has seven core values and loyalty is #1. It's defined as
The catch with Milley is that if you accuse him of being disloyal to the President, he'll argue that he was serving "The People" or "The Constitution."

Like all Chairmen, Milley serves at the pleasure of the President. Trump should have fired him in June 2020 when Milley went public with an apology for having walked with Trump to St John's church. According to Milley, that walk showed that the military was somehow involved in civilian law enforcement.
And Trump said he was OK with Milley's apology. ???????
Milley was wrong to equate the use of active duty military to quell riots with "domestic politics." What he was essentially saying was that there were two political camps in America: Trump's and the Others who were behind the rioting.
Trump should have fired him immediately, declared an Insurrection and turned to a general with the balls to stop the rioting. Earlier that Summer, Trump had been threatening to use the military if governors failed to stop rioting. The rioting did not stop and Trump did nothing. Instead, he said he was OK with Milley's apology!!!!!
The fact that Trump failed to act is why I have doubts about handing him the keys to the White House a second time. Those of us who like this man have to demand THAT HE EXPLAIN HIS ACTIONS. He walked out of the White House leaving too many unanswered questions.
