Investigators have made a preliminary determination that the police officer who shot and killed Ashli Babbitt during the U.S. Capitol riot shouldn’t be charged with any crimes in connection with her death, according to people familiar with the review.

Ms. Babbitt, who served for more than a dozen years in the Air Force and Air National Guard and became a passionate supporter of former President Donald Trump, died from being shot by a Capitol Police officer after rioters smashed through a door to the Speaker’s Lobby on Jan. 6. She had entered the building as part of a crowd aiming to disrupt the certification of Biden’s victory in the 2020 presidential election.

The officer who shot her had been placed on leave soon after the riot while Ms. Babbitt’s death was being investigated, including on the question of whether it was a violation of her civil rights.

The Justice Department said in announcing the investigation that it was following routine procedure for whenever a police officer uses deadly force by having the Washington Metropolitan Police Department examine the shooting. The police investigators have made an initial determination that charges against the officer aren’t warranted, the people said, adding that Justice Department officials haven’t yet made a final determination on the matter. The U.S. attorney’s office in Washington is leading the broader investigation into the riot and prosecuting the more than 150 cases that have resulted to date.

A Justice Department spokeswoman had no immediate comment. Any final charging decision would likely have to be approved by senior Justice Department leadership, who haven’t yet been briefed on the matter.

I’m still confused on why Ashli was with BLM Utah Activist John Sullivan, and the CNN camera crew. As soon as Ashli was shot and killed Sullivan walked back downstairs and switched hats, as he was carrying three. Two hats and a helmet that is. Was she actually Antifa posing as a Trump supporter? Was she actually a Trump supporter, and was baited by Sullivan, who was pretending to be a Trump supporter, into doing something she shouldn’t have done? How does the officer have zero culpability? Was breaching the Capitol or even the chambers a capitol offense? No pun intended! If it did carry a death penalty, why weren’t the other people that were in the chambers shot and killed by the police that were in there with them? Will the people that are getting charged with trespassing on Capitol grounds or any of the other charges be put to death as a consequence for their actions?

I think she was pushed forward by that crowd of Antifa agitators and, if you listen closely to the video audit, she is being prompted to go through that window by all of them, including Sullivan. Sullivan was standing in a position where he could see that officer with the gun. I blame him, 100%. With all of those men there, why did they get the lady to take the big risk of being the first one in? This stinks, IMHO.

We have all seen the video of her shooting. He was not in immediate danger from this woman, he picked her out of a big crowd of which security Officers were part. He should be jailed.

I saw a video of the police opening the doors to let everyone in, i think 1 officer can be heard saying..its not my responsibility...unfortunately the Trump supporters just followed the Antifa guys in..in my view...collateral damage...and probably on purpose by Antifa to get the Trump supporters to follow and riled up...my bet is Ashli didnt know who this guy was.....you tend to follow the crowd if there is no resistance...the police did not resist until deep inside...therefore it was not trespassing...they opened the doors...what gets me is why police at the doors opened and stood by as they walked past then others inside drew their weapons and killed people...seemed like a planned DEMONCRAT setup to me...

The elephant in the room is this: WHY DID THEY USE DEADLY FORCE to begin with...AND...did Pelosi and other Dems have prior intel that said ANTIFA & other known domestic terrorists using social media to be "fake MAGA" and create the problem...which then gave law enforcement "probable cause" to use force? IF IT WALKS LIKE A DUCK and SQUAWKS LIKE A DUCK....just saying.
